Terms of Service

1. Acceptance
These Terms of Service (“Terms”) govern your access to and use of Originis, including our website, desktop applications, and related services (collectively, the “Service”), provided by Pistachio Technology Inc., a Delaware corporation (“Pistachio,” “we,” “us,” or “our”). By creating an account, signing in, or otherwise using the Service, you agree to these Terms and to our Privacy policy. If you do not agree, do not use the Service.
2. Eligibility
The Service is offered only to students, faculty, and staff of accredited U.S. higher education institutions. By using the Service, you represent that you are at least 18 years old, a resident of the United States, and affiliated with a U.S. higher education institution that permits your use of Originis. The Service is not directed to individuals under 18 or to users outside the United States, and we do not knowingly collect information from such individuals.
3. Accounts
You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Credentials are personal to you and may not be shared. Notify us promptly at jack@pistachio.support if you suspect unauthorized access to your account.
4. The service
Originis is a secure online exam platform for instructors and test takers. It includes a web application for instructors and desktop applications for test takers on Windows and macOS. Features, availability, and system requirements may change over time, and we may add, modify, or discontinue features at our discretion.
5. Institutional use
Originis is typically made available to you through your institution. Your institution determines which exams you take, how they are administered, and what conduct policies apply. Your use of the Service is also subject to your institution’s policies, including its academic integrity and student records policies. Questions about how your institution uses Originis — including accommodations, scheduling, and grading — should be directed to your institution.
6. Webcam capture and recorded exams
The Originis desktop applications capture video from your webcam during exam sessions to support academic integrity. By starting an exam in the desktop application, you expressly consent to webcam capture as described in this Section and in our Privacy policy.
- Scope of capture. Webcam recording occurs only during exam sessions you have joined through the desktop application. It does not occur on the marketing website, while the application is idle, or before or after an exam session.
- Purpose. Recorded video is used solely to review for potential academic misconduct. We do not perform facial recognition, generate biometric identifiers or templates, or apply any other biometric analysis to the video.
- Operating-system permission. The application relies on your operating system’s camera permission. You may grant or revoke camera access at any time through system settings; revoking access may prevent you from completing an exam.
- How footage is handled. Captured video is stored, retained, and accessed as described in our Privacy policy.
- Declining capture. If you do not consent to webcam capture, do not start an exam in the desktop application. Contact your institution about alternative arrangements.
7. Acceptable use
You agree not to:
- Attempt to circumvent, disable, or tamper with proctoring or security controls;
- Share, distribute, or reproduce exam content without authorization;
- Reverse engineer, decompile, or otherwise attempt to extract source code from the Service;
- Use the Service to violate any applicable law or the rights of others;
- Access the Service through automated means or use it to build a competing product.
8. Intellectual property
The Service, including its software, design, and content we provide, is owned by Pistachio Technology Inc. and its licensors and is protected by U.S. and international intellectual property laws. These Terms grant you a limited, personal, non-transferable, non-exclusive, revocable right to use the Service in accordance with these Terms and for no other purpose.
9. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PISTACHIO TECHNOLOGY INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE AND (B) ONE HUNDRED U.S. DOLLARS (US$100).
11. Indemnification
You agree to defend, indemnify, and hold harmless Pistachio Technology Inc. and its officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms, your misuse of the Service, or your violation of any law or the rights of a third party.
12. Governing law and venue
These Terms, and any dispute arising out of or relating to these Terms or the Service, are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Subject to Section 13, the state and federal courts located in Wilmington, Delaware have exclusive jurisdiction over any matter not subject to arbitration, and you consent to the personal jurisdiction of those courts.
13. Dispute resolution; arbitration; class-action waiver
Informal resolution. Before filing any claim, you agree to contact us at jack@pistachio.support and attempt to resolve the dispute informally for at least 30 days.
Binding arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service (a “Dispute”) that is not resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be conducted in English and seated in Wilmington, Delaware, unless you and we agree otherwise. Judgment on the award may be entered in any court of competent jurisdiction.
Class-action waiver. YOU AND PISTACHIO TECHNOLOGY INC. AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. THE ARBITRATOR MAY NOT CONSOLIDATE CLAIMS OR PRESIDE OVER ANY REPRESENTATIVE PROCEEDING.
Opt-out. You may opt out of this arbitration agreement by sending written notice to jack@pistachio.support within 30 days of first accepting these Terms. Claims of intellectual-property infringement or misappropriation may be brought in court for injunctive relief.
14. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if we need to do so to protect the Service or other users. You may stop using the Service at any time. Sections that by their nature should survive termination will survive, including Sections 8–13 and 16.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we will post the revised version on this page and update the “Last updated” date above. Material changes will be communicated through the Service or by other reasonable means. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
16. Miscellaneous
These Terms, together with our Privacy policy, constitute the entire agreement between you and Pistachio Technology Inc. regarding the Service and supersede any prior agreements. If any provision is held unenforceable, the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver. You may not assign or transfer these Terms without our prior written consent; we may assign them freely. Section headings are for convenience only and do not affect interpretation.
